By agreeing the terms and conditions set out below, the submitter(s):
- Understands and agrees that in submitting your work for consideration, you acknowledge that you accept all of the terms and conditions set out below
- Acknowledges and agrees that he/she/they reside(s) in the United Kingdom and is/are over the age of 18 years old.
- May apply individually or as a writing partnership. If submitting The Work as a partnership, a primary contact will be stated on the submission, but all writers must be named on the submission.
- Understands that if another company expresses interest, options The Work or enters a writer’s agreement with them they will inform Scattered Pictures immediately.
- Will retain a copy of their project and understands not to send Scattered Pictures the only copy of The Work. The Company cannot be held responsible for the safe return of your submission.
- Grants Scattered Pictures the right to read and evaluate The Work plus any and all accompanying work with the understanding that The Company has no obligation to develop or produce it. In addition, it is understood that no partnership is established by submitting The Work or any material to The Company.
- Warrants and represents that (a) the submitter(s) is/are the sole owner(s) of The Work submitted and its intellectual property rights and that The Work is original to him/her/them (or, if based upon an existing work that they have secured the underlying rights) and (b) has full right to submit The Work to The Company upon all the terms and conditions stated herein. The submitter(s) will indemnify, defend and hold The Company harmless from and against any and all claims, loss, damage or liability (including responsible attorney’s fees) that may be asserted against The Company at any time in connection with The Work and/or any material and use thereof, arising from any breach or alleged breach of these warranties.
- Acknowledges that the Company is under no obligation to option any projects submitted.
- Acknowledges that The Company is exposed to many concepts, ideas, stories and other literary material, through various means. The submitter(s) also accept(s) that many concepts, ideas and stories are similar or identical, and that different concepts, ideas and stories frequently relate to one or more common underlying themes and may closely resemble other works.
- Acknowledges and agrees that he/she/they will not be entitled to any compensation because of the use of such similar or identical concepts, ideas and/or stories that may have come to The Company. By submitting The Work to The Company the submitter(s) release The Company from any and all claims, liabilities and demands that may be made by the submitter(s) asserting that Scattered Pictures has used or appropriated The Work, or any part thereof.
- Acknowledges that under English Law copyright is an automatic right and, as The Company is a company registered in England and Wales, the applicant’s work is protected by the Intellectual Property Laws of the Copyright, Designs and Patents Acts 1988 (as amended).
- Acknowledges and agrees that The Company is under no obligation other than to assess the material submitted and has no further obligation whatsoever to the submitter(s).
- Acknowledges that literary evaluation is a subjective process, allowing for reasonable disagreement as to the relative merits of The Work. If any feedback is given to the submitter(s) understand the evaluation may, or may not be complimentary or positive in its judgement.
- Acknowledges that the terms set out on this page shall be interpreted in accordance with English Law and in the event of any dispute, the Courts of England and Wales will have jurisdiction.
